The Court rejected our argument that our defendant doctor was entitled to the same ERISA preemption protection as the HMO for which he was acting. But the Court made new law by stating that our doctor could bring a third-party action against the HMO for contribution and indemnity, even though plaintiff's action was for medical malpractice. - Greenfield v.
